Welcome to Happy Llama.

These Terms of Service ("Terms") apply when you visit, use or make a purchase through our website and online store.

Throughout these Terms, "Happy Llama", "we", "us" and "our" refer to Happy Llama.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products to you.

By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Refund Policy and other policies made available on our website.

Nothing in these Terms excludes, restricts or limits any statutory rights available to consumers under applicable Irish or European Union law.

2. Our Products

We take reasonable care to describe and display our products accurately.

Many Happy Llama products are individually handmade and/or made using natural materials. As a result, slight variations in colour, texture, size, shape, expression and finish may occur.

These variations are part of the individual character of handmade products and mean that no two pieces may be exactly alike.

Colours may also appear slightly different depending on your screen, device and display settings.

Product photographs are intended to provide an accurate representation of our products, but where products are individually handmade, the item received may have natural variations from the item photographed.

This does not affect your statutory rights where goods are faulty, damaged or not as described.

We may change or discontinue products and may limit quantities or availability where reasonably necessary.

3. Orders

When you place an order through our website, you are making an offer to purchase the products in your order.

We will provide an order confirmation electronically.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

- a product is unavailable;

- there has been an obvious pricing or product information error;

- payment cannot be authorised;

- we reasonably suspect fraudulent or unauthorised activity; or

- we cannot legally fulfil the order.

If we cancel an order after payment has been taken, we will refund the relevant amount.

Please check your order details carefully before submitting your order.

Cancellation and return rights are explained in our Refund & Return Policy and are subject to your statutory consumer rights.

4. Prices and Payment

Prices displayed on our website are shown in euro (€) unless otherwise stated.

The total amount payable, including applicable delivery charges and other charges known to us, will be displayed before you complete your purchase.

You are responsible for providing accurate and complete billing, payment and delivery information.

Payments are processed securely through the payment methods available at checkout.

We may change product prices at any time, but price changes will not affect orders that have already been accepted, except where permitted by applicable law.

5. Shipping and Delivery

Delivery options, estimated delivery times and applicable charges are provided through our website and/or during checkout.

Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly agree otherwise.

We will take reasonable steps to deliver your order within the agreed timeframe.

Where no specific delivery time has been agreed, goods will be delivered without undue delay and within the timeframe required by applicable consumer law.

Happy Llama remains responsible for goods during delivery until you, or a person nominated by you, takes physical possession of them, except where you independently arrange a carrier that was not offered by us, in circumstances where applicable law provides otherwise.

If your order is lost, damaged during delivery or does not arrive, please contact us at info@happyllama.ie so that we can investigate and provide the appropriate remedy.

Nothing in this section limits your statutory rights regarding delayed, lost or undelivered goods.

6. Returns, Cancellations and Faulty Goods

Returns and cancellations are governed by our Refund & Return Policy and applicable consumer law.

Happy Llama provides a voluntary 30-day return policy, subject to the conditions described in our Refund & Return Policy.

Consumers purchasing online may also have a statutory 14-day right of withdrawal, subject to applicable exceptions.

Separate statutory rights apply where goods are faulty, damaged or not as described.

Nothing in our Refund & Return Policy or these Terms limits those statutory rights.

7. Handmade and Personalised Products

Some Happy Llama products are handmade, customised, personalised or made to order.

Natural variations associated with handmade products are not, by themselves, defects.

Certain personalised, customised or made-to-order goods may be excluded from the statutory right of withdrawal where an applicable legal exception applies.

This does not affect your statutory rights where goods are faulty, damaged or not as described.

8. Product Use and Safety

Please read and follow any product information, care instructions, age guidance and safety warnings supplied with a Happy Llama product or displayed on the relevant product page.

Products should only be used for their intended purpose.

Certain Happy Llama products are sold as decorative items rather than toys. Where applicable, this will be stated in the product information and/or accompanying labelling.

Nothing in this section excludes or limits any rights or remedies provided by applicable product safety or consumer protection law.

9. Intellectual Property

Unless otherwise stated, the content of the Happy Llama website, including our original text, photographs, graphics, branding, designs, videos and other original content, is owned by or licensed to Happy Llama and is protected by applicable intellectual property law.

You may use our website for personal and lawful purposes.

You may not reproduce, commercially exploit, distribute or use Happy Llama content or branding without permission where such use would infringe our intellectual property rights or the rights of our licensors.

Third-party trademarks and content remain the property of their respective owners.

10. Reviews and User Content

If you submit a product review, photograph or other content to Happy Llama, you confirm that you have the right to provide that content.

You must not submit content that is unlawful, misleading, defamatory, abusive or infringes another person's intellectual property, privacy or other legal rights.

Where you give us permission to publish content, we may display it in connection with Happy Llama and our products, subject to applicable law.

We do not publish or commission fake consumer reviews.

Our online store is powered by Shopify.

Purchases made from our Happy Llama store are contracts between you and Happy Llama, not Shopify.

Failure by Happy Llama to enforce a provision of these Terms does not waive any right to enforce it later.
